(including its affiliated entities and subsidiaries, hereinafter referred to as the “Company” or “We”) may obtain or collect in the course of your using any of software products and services of MOGOS, including its map, GPS navigation, and location based services (hereinafter referred to as the "Service" or “MOGOS”). Company respects privacy of personal data and attach particular importance to the respect for the privacy of the users and of the confidentiality of their personal data.

Through this Policy, the Company regards personal information of the users as important and has established a management policy for personal information. In addition to complying with the law (“Act on Promotion of Information and Communication Network Use and Information Protection”, “Personal Information Protection Act”, etc.) to protect the personal information, the company informs the purpose and processes of using the personal information provided by the users and the measures taken for protection of those personal information as follows.

The Company is the controller of the information provided or collected in the applications on which this Policy is posted.

Definitions

Personal data: information, whether true or false, we receive through the MOGOS in providing you the Service.

Processing of personal data: any operation or any set of operations relating to personal data, whatever the process used, and in particular the collection, storage, adaptation or alteration, retrieval, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, as well as locking, erasure, or destruction.

Background of collecting and processing personal data

The personal data collected by MOGOS during the provision of the Services is necessary to allow MOGOS to pursue its legitimate Service while respecting the rights of the Users. However, the Company is not allowed to process your personal data if it does not have a valid legal ground. Therefore, MOGOS on your device only collects and process your personal data if: (i) necessary to perform contractual obligations between you and the Company; (ii) to provide you with our products and services(i.e. delivery of search results in response to your address/location/route search queries, search history and other information available to MOGOS), to process your requests or as otherwise may be necessary to perform the contract between you and MOGOS, to ensure the functionality and security of our products and services, to identify you as well as to prevent and investigate fraud and other misuses; (iii) to enhance, maintaining accessibility, modify, personalize or otherwise improve the MOGOS software products and Services for the benefit of all users; (iv) to develop and manage our products, services, customer care. We may combine personal data collected in connection with your use of a MOGOS product and/or service with other personal data we may have about you, unless such personal data was collected for a purpose, where the original purpose is incompatible with this purpose.

The Services we provide

1. Navigation MOGOS accesses device's location to deliver real-time turn-by-turn navigation and automated dynamic routing based on current location.

2. Location based services Offering Users services related to maps or location, such as finding nearby POIs, search address, direction.

Purpose of this Policy

This privacy policy(“Policy”) describes how we collect personal data where the Company is the data controller or where it refers to the applicability of this Policy.

We will give you additional privacy information that is specific to a product or service in Supplements to this Policy and other notices you may see while using our products or services. If there is a difference between such notices and this Policy, the notices should be considered first.

Sharing and Disclosure of Data

We will not disclose any of your personal data collected throughout the use of Services to any other person without Users prior consent. User, however, acknowledges and agrees that we may disclose your personal data for such purposes: (i) We will share your personal data if we, in our honest belief, deem it necessary for us to do so to comply with the applicable laws, or in response to the legal process such as search warrants, court orders or summons; (ii) In addition, we will share your personal data in the event if we honestly believe it necessary for our purpose or for a lawful interest of a third party in relation to national security, law enforcement, legal action, criminal investigation, security of any person, or for prevention of impending death or physical injuries if we deem that such lawful interest overrides your lawful interest of fundamental right and freedom to the protection of your personal data.

Recipients of the data

Disclose of your personal data shall be made for the purpose of business administration and provision of the Services on our application. It may be transmitted to our subsidiaries, or to third-party data processors which MOGOS is authorized to use within the context of the performance of its Services. MOGOS implements guarantees ensuring the protection and security of this data, in compliance with applicable rules and regulations.

MOGOS does not transfer or rent personal data to third parties for marketing purposes without the express consent of the Users of MOGOS.

In addition, personal data may only be disclosed to third parties for purposes other than marketing in the following cases: (i) with their authorization; (ii) at the request of the competent legal authorities, upon judicial request, or in the context of a legal dispute.

General Rule

1. We complies with the personal information protection regulations related to personal information such as "Law concerning promotion of use of information and communication networks and information protection" and "Personal information protection law". Company respects the privacy of personal data of our Users and attach particular importance to the respect for the privacy of the Users and of the confidentiality of their personal data. Company committed to processing the data in compliance with the applicable laws and regulations and in particular Personal Data Protection Act B.E. 2562 (2019) and other applicable laws on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereafter referred to as the “GDPR”).

2. The company's "Personal Information Protection Policy" is subject to change due to changes in related laws and guidelines and changes in internal management policies. Type of personal data collected

The Company may collect the information directly provided by the users and in the course of that the users use the service provided by the Company. Users may be unable to access and use the Service if such personal data are not provided:

1. Location data
To provide accurate navigation guidance and location-based services, this app collects your location data.

We use this data to:

(i) Location based search, navigation and routing, or request for map data, your location data is sent to the Company to serve you with the right content

(ii) Continuously track your location to improve real-time route guidance

(iii) Ensure location-based features work seamlessly, such as alerts and logs

If you do not allow location access, some key features may not work, and the service may not be available. Your location data is never shared with third parties.

2. Storage Access
This app requires access to your device’s storage in order to:

(i) Store map data for faster loading and offline use

(ii) Cache navigation and location content during operation

(iii) Improve performance by minimizing real-time data usage

Without storage access, some map and navigation features may not work properly or may load slower. This permission is necessary for providing a seamless experience, especially in areas with poor network connectivity.

3. Microphone Access
This app uses your microphone to enable voice-based place name search. With this feature, you can conveniently speak to search for locations instead of typing. We do not record or store any voice data beyond what is necessary to process your request. Without microphone access, you won’t be able to use voice search features, and will need to enter location names manually.

4. Notification Access
To ensure transparency while the app runs in the background, we display a system notification indicating that the app is active. This requires notification permission. Without it, the app may not function properly or you may not be aware that it's running in the background.

5. Anonymised data
Technical data including your service access, time zone setting and location, operating system and platform and other technology on the devices you use to access the services. Technical data may be derived from your personal data but is not considered Personal Data in law as this data does not directly or indirectly reveal your identity.

6. Special category personal data
We do not collect any special categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, genetic and biometric data).

Legal obligations

We process your personal data as needed to comply with laws and regulations. We take the protection of your personal information very seriously and do our best to ensure that your personal information is not damaged, infringed or leaked. However, despite taking technical supplementary measures, we will not be held responsible for the damage of information due to unexpected accidents caused by basic network risks such as hacking and various disputes due to articles created by visitors.

Your rights

In all the above cases in which we collect, use your personal data, you may have the following rights which you can exercise free of charge. These rights include: (i) the right to withdraw your consent to the processing of your Personal Data at any time. Please note, however, that we may still be entitled to process your Personal Data if we have another legitimate reason for doing so. You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.

Use of collected information

The company will use the customer's personal information within the agreed range, will not use it beyond the same range, and will not provide it to others or other companies / organizations. However, in the following cases, you can use and provide personal information with caution:

Safeguard person data

This app is not intended for children under the age of 13 (or under the age of 16 in the EU). We do not knowingly collect personal data from minors. If we become aware that we have collected personal data from a child without parental consent, we will take steps to delete it promptly.
